General Terms and Conditions of Use

1. Definitions

The terms defined below shall have, in these general terms and conditions, the meaning attributed to them below, each time they begin with a capital letter, whether used in the singular or plural.

"Listing": refers to a Rental or Co-navigation offer published by an Owner on the Website.
"Boat-Manager": refers to the intermediation service connecting Owners with concierges who handle check-in, check-out and welcome Renters on behalf of Owners.
"GTC": refers to these general terms and conditions of use.
"LISTA SÉPTIMA": refers to the company LISTA SÉPTIMA BALEARES S.L, a limited liability company, with registered office at Paseo de la Habana 18, 28036, Madrid, registered in the Madrid Commercial Register at Sheet M-794786, Volume 45166, Page 40.
"Experience": refers to a day trip aboard a Vessel, necessarily carried out with a skipper, in which the User participates in navigation according to a route or navigation plan previously established by the Owner/Shipowner and/or the designated skipper. Unlike a Rental, the Experience does not involve the transfer of use or possession of the Vessel to the User, but rather the provision of a guided nautical activity.
"LISTA SÉPTIMA Commissions": refers to a commission percentage included in the Renter's Price and payable by the Renter as remuneration for the service. The amount of this commission may vary according to the conditions set at any time by LISTA SÉPTIMA, and shall be established in the Naval Management contract entered into between LISTA SÉPTIMA and the RENTER.
"Content": refers to any text, graphic, image, video, information or other elements that Users post, upload, publish, send, transmit or include in their Listing or User account to make available on the Website.
"Vessel": refers to any nautical vehicle listed for Rental on the Website (such as sailing boats, motorboats, barges, catamarans, jet skis, etc.).
"Renter": refers to any natural or legal person who books a Vessel for Rental or for an Experience.
"Rental": refers to the rental of a Vessel to a Renter by an Owner, at the dock or at sea.
"Additional Options": refers to the options that the Renter may subscribe to in addition to the Owner's Price (bedding costs, cleaning, etc.).
"Handover": refers to the delivery of the Vessel or arrival at the Vessel on the first day of the Rental and/or the Experience. The time for cleaning, refuelling and reviewing the Entry and Exit Inventory is part of the rental period set out in the contract.
"Entry Inventory Report": the document describing the condition of the vessel at the time of Handover, to be drawn up between the Renter and the Owner (or their representative) at the time of delivery of the boat. It must be as comprehensive as possible, with supporting photographs and comments, and signed by both parties before the boat departs.
"Exit Inventory": the document describing the condition of the boat at the end of the Rental, to be completed with a damage report if applicable. It must be as accurate as possible and submitted digitally to LISTA SÉPTIMA within 48 hours of the end of the RENTAL or EXPERIENCE.
"Renter's Price": refers to the price shown in the Listing excluding Additional Options. It does not include the Vessel's berth in the port or the cost of fuel, unless otherwise stated in the Listing.
"Owner's Price": refers to the price freely chosen by the Owner at the time of publishing their Listing, to which the LISTA SÉPTIMA commission will be added.
"Owner": refers to any natural or legal person, professional or private, who can justify full ownership of a Vessel if requested by LISTA SÉPTIMA and/or a Renter. By extension, it also refers to a representative of an Owner.
"Professional Owner": refers to any owner who uses the Service in a professional capacity and whose activity is registered in the commercial register in accordance with the regulations in force.
"Private Owner": refers to any owner who does not use the Service in a professional capacity in accordance with the regulations in force.
"Service": refers to the combination of (i) the service connecting Owners and Renters to facilitate Co-navigation or Vessel Rental, and (ii) the booking and payment management tool between Users.
"Website": refers to the website www.listaseptima.com.
"User": refers to any user of the Website and the Service, whether as Owner or Renter.
"Cancellation due to weather forecast": refers to the cancellation of a booking due to a special weather forecast.

2. Acceptance of the GTC

Use of the Service and the Website is subject to these GTC. The GTC constitute a contract governing the relationship between the User and LISTA SÉPTIMA. They supersede and replace all previous provisions and constitute the entirety of the rights and obligations of LISTA SÉPTIMA and the User for their purpose. The Parties agree that in the event of any inconsistency between the information on the Website and the GTC, the GTC shall prevail.

The User is deemed to give their full and complete acceptance, without reservation, of these GTC from the moment they tick the box "I accept the general terms and conditions" when creating their User account or subscribing to an offer.

If this box is not ticked, the User acknowledges that the creation of a User account and use of the Service is not possible or valid.

LISTA SÉPTIMA reserves the right to make modifications at any time, which shall take effect from the moment of their publication on the Website. By continuing to use the Website, Users tacitly accept the latest updated version of the GTC.

3. Purpose of the Service

The Service offered through the website consists of connecting Owners and Renters to facilitate the conclusion of a nautical rental contract between the two parties and, where applicable, the management of bookings and processing of payments between Users.

Each User understands and accepts that LISTA SÉPTIMA acts at all times as a third party facilitating the conclusion of the contract between Owner and Renter, and is therefore not a party to the contract formalised between them. Consequently, the nautical rental contract shall be deemed concluded exclusively between the Owner (Shipowner) and the Renter, and LISTA SÉPTIMA shall not hold the status of lessor nor assume obligations on behalf of either party.

Without prejudice to the above, LISTA SÉPTIMA performs the role of commercial manager and intermediary, aimed at facilitating the booking process, operational communication and, where applicable, payment management through the platform.

LISTA SÉPTIMA also carries out verification and control activities to check, to the extent reasonably possible, that the vessels listed on the platform have the required documents and insurance. However, such verification does not make LISTA SÉPTIMA directly responsible for the vessel.

Where the Renter contracts with a Professional Owner, the contract and/or particular conditions issued by that Professional Owner shall prevail over any model contract or document provided by LISTA SÉPTIMA.

4. Access to the Service

Users of the LISTA SÉPTIMA platform undertake to provide accurate information. LISTA SÉPTIMA is not responsible for confirming the identity and information communicated by Users. In the interests of transparency and to prevent fraud, LISTA SÉPTIMA may ask Users to provide an official identity document or other information.

4.1. Legal capacity

The Service is reserved for individuals who are of legal age, emancipated minors with full legal capacity, and legal entities that can comply without reservation with these GTC.

4.2. Access

To use their User account, the User must have a valid email address and mobile phone number throughout the period of use of the Service. In the case of Owners, they must also have a bank account number (IBAN) to which the amount of each rental can be transferred.

5. Use of the Service

5.1. Creating a User account

To use the Service, the User must first create a User account by following the process shown on the Website and/or received by email.

The User is solely responsible for maintaining the confidentiality of their login credentials. Consequently, LISTA SÉPTIMA is not responsible if the Service is used by a person other than the User or by an unauthorised third party.

In the event of a lost or forgotten password, the User may use the password reset system available on the Website. In the event of misuse by third parties, the User undertakes to inform LISTA SÉPTIMA as soon as possible by email at [email protected].

5.2. Publishing a Listing

Any Owner may create one or more Listings free of charge to offer a Vessel for an Experience and/or Rental, subject to the provisions of article 6.1.1. However, the creation of a Listing does not result in its automatic publication on the Website. All Listings will be pending verification by the LISTA SÉPTIMA administration team.

The Listing must include at least one photograph of the Vessel and must specify:

The characteristics and location of the Vessel.
The applicable fuel policy.
The nautical qualifications required for its use.
The Vessel's availability dates.
The daily Owner's Price chosen based on the availability dates.
The amount of any security deposit or guarantee required for the Rental.
Any additional costs (bedding, cleaning).
The cancellation conditions for the Rental or Experience chosen by the Owner in accordance with article 7.3.

The Owner's Price is freely chosen by the Owner, to which the LISTA SÉPTIMA Commission will be added. LISTA SÉPTIMA will display in the published Listing the Renter's Price, corresponding to the total price in euros that the Renter must pay, including (i) the Owner's Price, (ii) any additional costs expressly mentioned in the Listing, and (iii) the LISTA SÉPTIMA Commission. Price includes VAT and excludes fuel costs, unless otherwise stated in the Listing.

5.3. Insurance

#### 5.3.1. Owner

The Owner undertakes to only offer for booking Vessels that have valid insurance adequately covering Rental and/or Experience activities, regardless of the User's nationality, the intended navigation area and/or the Vessel's usual home port.

5.4. Renter's booking request

The Renter must select on the Website the Vessel, the handover/start date and the end date of the Rental or Experience and, where applicable, the additional options offered by the Owner. The Renter will then send a Booking Request, which must be expressly accepted by the Owner for the booking to be considered confirmed.

The Booking Request does not guarantee the availability of the Vessel. If it is rejected or expires, this will entail no cost to the Renter.

The Owner will have between 1 and 24 hours to accept or reject the Booking Request. After this period without a response, the Booking Request will automatically expire.

5.5. Vessel booking

The amount of the Renter's Price is paid at the time of booking and held in a blocked account managed by LISTA SÉPTIMA until the Rental or Experience is completed without incidents. Only once it is confirmed that the Rental or Experience has been carried out as agreed will LISTA SÉPTIMA proceed to pay the Owner or, in the event of cancellation or refund, reimburse the Renter.

On the day of Handover, the Owner and Renter undertake to carry out a contradictory entry inspection and to sign a Rental or Experience contract between themselves.

On the final day of the Rental or Experience, the Owner and Renter undertake to carry out a contradictory exit inspection.

5.6. Security deposit

The Owner may require a security deposit for the Vessel Rental, the amount of which must always be expressly stated in the Listing. Under no circumstances may the Owner demand an additional or different security deposit once the booking is confirmed.

Within 48 hours of the end of the Rental, the Owner may request LISTA SÉPTIMA to open a claim file if they notice any damage to their Vessel that was not included in the entry inventory. This request must be made directly through the website and must be accompanied by the signed Rental contract, the signed inventory reports, and dated photographs and videos of the damage.

LISTA SÉPTIMA will only return the deposit amount to the Owner upon presentation of the final invoice or a pro-forma invoice, unless both parties agree otherwise.

5.7. User reviews

Each user may review another User with whom they have signed a Rental or Experience contract by writing a comment and/or using a rating system. Only Rentals and/or Experiences that have actually taken place give the right to publish a review.

Users cannot delete a comment written by another User, but they have the right to respond to comments.

LISTA SÉPTIMA reserves the right to delete any comment that violates applicable rules, as well as to delete User accounts in the event of repeated inappropriate comments.

6. Obligations of the parties

6.1. User obligations

The User undertakes to:

Use the Website and the Service in accordance with these GTC and applicable regulations.
Provide truthful, lawful and objective information, refraining from publishing content contrary to the law or the rights of third parties.
Act in good faith at all times in using the Website and the Service.
Hold only one User account, undertaking not to create accounts in the name of third parties or use third-party identities.
Keep their information up to date.
Not transfer or allow the use of their account to third parties or other Users.
Maintain the confidentiality of their credentials and access codes.
Be able to verify at any time the titles, licences and/or qualifications indicated in their profile.
Comply with all applicable administrative, health and other formal requirements.
Expressly accept the GTC before making any Rental or Experience booking.

#### 6.1.1. Specific obligations of the Owner

The Owner undertakes to:

Be able to verify at all times their status as Owner of the Vessel and/or their entitlement to offer it on the platform.
Have the Vessel duly registered and/or enrolled with the competent authorities, where applicable.
Only offer for booking Vessels in proper working condition, duly equipped and maintained.
Make available to the Renter all required documentation and records.
Have taken out and maintain valid insurance covering the offered activity, and provide a valid insurance certificate when requested by LISTA SÉPTIMA and/or the Renter.
In the case of Private Owners, declare and guarantee that they have completed the legal formalities required for the commercial use of their Vessel and have entered into the corresponding Naval Management Contract with LISTA SÉPTIMA.
Verify the Renter's identity before signing the Rental contract.
Verify that the Renter holds the required titles, licences and/or qualifications for the use of the Vessel.
Inform the Renter of any relevant coverage limitations or liability arising from their insurer.
Submit to LISTA SÉPTIMA the invoices or payment documentation required for the correct management of rental amounts.

#### 6.1.2. Specific obligations of the Renter

The Renter undertakes to:

Have in their bank account the security deposit amount, if applicable, from the Booking Request until 24 hours after the end date of the Rental.
Be the owner of the bank card used to book the Vessel.
Verify the condition of the Vessel and the presence of an appropriate safety system before signing the Rental contract.
Inform LISTA SÉPTIMA of any dispute/disagreement related to the Listing and/or the Vessel.
Pay any penalties incurred during the Rental period.
Hold the titles, permits and/or qualifications required for the vessel and the navigation plan.
Arrive at the agreed time to meet the Owner or their representative.
Only allow the number of persons permitted by the vessel's safety system to board.
Use the boat responsibly for recreational navigation, in compliance with applicable maritime and customs legislation.
Not be medically unfit to navigate/operate the vessel.
Return the boat to the Owner with all its equipment in the same condition as at the start of the rental.
Return the vessel with the same fuel level as when it was collected, unless otherwise agreed.
Return the boat to its departure port, unless the Owner has agreed otherwise in writing.

6.2. LISTA SÉPTIMA's obligations

LISTA SÉPTIMA undertakes to make every effort to:

Ensure the functioning of the Website in accordance with article 9.
Respond to User requests relating to the Service as quickly as possible.
Pay the amount owed to the Owner by bank transfer to their account.
Pay the security deposit amount to the Owner once the damage caused and its cost have been demonstrated and substantiated.
Make a refund, where applicable, to the Renter in accordance with article 7.
Allow Users to download from their account the invoices relating to bookings made or received.

7. Booking cancellation

The User may cancel a booking directly from the platform by accessing their User account and selecting the option "Cancel booking" in the details of the relevant booking. Cancellation will be deemed effective at the moment the system records this action.

7.1. Cancellation due to force majeure

When a force majeure event arises as provided in article 11, any User may request, within 12 hours of the Handover date, (i) the postponement of the booking to a later date or (ii) its cancellation, provided they document such circumstances to LISTA SÉPTIMA through the means available on the platform.

#### 7.1.1. Cancellation due to special weather forecast

In the event of cancellation due to a special weather forecast preventing navigation, duly evidenced through official sources, and provided the booking is for a duration of one day or less:

LISTA SÉPTIMA will fully refund the Renter the entire Renter's Price, including the LISTA SÉPTIMA Commission, using the same payment method used for the booking.
The refund will be made within a maximum of fifteen (15) calendar days from the cancellation.
The Owner will not receive any amount as Owner's Price.

For bookings managed by a Professional Owner, the cancellation conditions set by the Professional Owner shall apply exclusively.

7.2. Cancellation by the Owner

The Owner may not cancel an already confirmed booking, except in the force majeure cases provided in article 11. Accumulation of two (2) unjustified or abusive cancellations will entitle LISTA SÉPTIMA to permanently delete the Owner's User account.

#### 7.2.1. Cancellation by a Private Owner

When the cancellation arises from the Owner's assessment, at the time of Handover, that the Renter's navigation level is manifestly insufficient for the safe handling of the vessel:

The Renter will receive a full refund of the Renter's Price, less the LISTA SÉPTIMA Commission, within a maximum of fifteen (15) calendar days.
The Private Owner will not receive the Owner's Price.

#### 7.2.2. Cancellation by a Professional Owner

In the same circumstances of manifestly insufficient nautical skills, the Professional Owner may cancel the booking and shall be responsible for directly refunding the Renter the Renter's Price, less the LISTA SÉPTIMA Commission. LISTA SÉPTIMA assumes no responsibility and will not intervene in the refund process.

7.3. Cancellation by the Renter

The Renter may cancel their booking at any time through the "Cancel booking" option in their booking details. The financial consequences of cancellation will depend expressly on the cancellation policy assigned to the vessel listing.

#### 7.3.1. Cancellation options

a) Non-refundable cancellation

If the listing provides for this option, cancellation by the Renter will not entitle them to any refund, and all amounts paid will be forfeited.

b) Free cancellation up to 24 hours before the start

If the Renter cancels at least 24 hours before the Handover date and time, the full amount paid will be refunded. If cancellation occurs within 24 hours of Handover, no refund will be made.

c) Free cancellation up to 10 days before the start

If the Renter cancels at least 10 calendar days before the Handover date, a full refund of the amounts paid will be made. If cancellation occurs within 10 calendar days of Handover, no refund will be made.

#### 7.3.2. Refund timeline and method

Where a refund is applicable under the relevant policy, LISTA SÉPTIMA will process it within a maximum of fifteen (15) calendar days from the cancellation, using the same payment method used by the Renter for the booking.

#### 7.3.3. Discrepancy between the vessel and the listing

a) Private Owner: The Renter must notify LISTA SÉPTIMA of any discrepancy before the start of the Rental or Experience. If the Renter decides to cancel for this reason, LISTA SÉPTIMA will fully refund the Renter's Price within fifteen (15) calendar days.

b) Professional Owner: The Renter must direct their claim directly to the Professional Owner. LISTA SÉPTIMA assumes no responsibility and will not intervene in the refund process.

#### 7.3.4. Serious breakdown during the Rental or Experience

a) Private Owner: If a serious breakdown occurs during the Rental or Experience that prevents the use of the vessel, the Renter must report the incident to LISTA SÉPTIMA with all available supporting documents. LISTA SÉPTIMA will assess, on a case-by-case basis, whether to offer any compensation, which shall never be automatic or constitute an enforceable obligation.

b) Professional Owner: The Renter must direct any claims arising from breakdowns directly to the Professional Owner. LISTA SÉPTIMA assumes no responsibility and will not intervene in these cases.

7.4. Cancellation by LISTA SÉPTIMA

In some cases, LISTA SÉPTIMA may be required to cancel a booking (cessation of collaboration with an Owner, User breach of obligations, etc.). LISTA SÉPTIMA will then make every effort to offer the Renter an equivalent alternative. If this is not possible, the Renter will receive a full refund.

8. Payment conditions for the Rental or Experience

The Renter's Price is paid in advance for each booking by bank card on the Website through the Stripe payment solution.

As an exception, and subject to LISTA SÉPTIMA's express agreement, the User may pay by bank transfer.

Payment of the Renter's Price is made in a single instalment, unless other payment terms are specified in the listing and booking conditions.

The Owner shall issue an invoice to LISTA SÉPTIMA for the Renter's Price amount minus the LISTA SÉPTIMA commission amount. The Owner must send invoices to LISTA SÉPTIMA by email or through the official means provided by LISTA SÉPTIMA.

9. Administrative management services

In addition to its intermediation activities, LISTA SÉPTIMA offers Owners technical administrative services specialising in the administrative regularisation of recreational vessels (List 7).

9.1. Basic management pack (legal regularisation)

This service consists of administrative processing before the Maritime Authority and competent authorities to obtain authorisation for a temporary change of use (from private to commercial).

#### 9.1.1. Detailed service content

a) Comprehensive review of the vessel's technical documentation.
b) Submission of the application to the relevant Maritime Authority for the temporary change of use from private to commercial.
c) Full monitoring of the file until the resolution/authorisation is obtained.
d) Administrative Dispatch: Includes dispatch management during the first year of contract. From the second year onwards, dispatch will cost €25 + VAT per management.
e) Technical platform activation: Listing publication, calendar configuration and full access to the LISTA SÉPTIMA booking system.

#### 9.1.2. Mandatory nature

Contracting this Pack is an essential and mandatory requirement for Private Owners of vessels on List 7 to be able to activate their Listing and receive bookings. It will not be mandatory for Professional Owners or vessels on List 6 that certify their compliance.

#### 9.1.3. Renewals

The dispatch included covers the first year of contract. Annual renewals will have a management cost of €25 + VAT, payable at the time of the renewal request.

After 5 years, upon expiry of the naval management contract, the contract and the authorisation with the Maritime Authority must be renewed.

9.2. Management pack (tax and accounting advisory)

In addition to all nautical formalities included in the Basic Pack, this service offers direct support through a specialist advisory firm for compliance with obligations arising from income received. LISTA SÉPTIMA will only act as intermediary between the CLIENT and the TAX ADVISORY FIRM.

This service is contracted under an annual subscription model that will automatically renew every 365 days. The subscription may be cancelled at any time by emailing [email protected], with a minimum of 2 days' notice before the renewal date.

9.3. Fees, payment methods and invoicing

The cost of services will be as stipulated at the URL /nuestros-planes/. LISTA SÉPTIMA reserves the right to apply discount codes or temporary promotions. Discounts and promotions will only apply to the first payment and not to subsequent renewals.

Accepted payment methods: credit or debit card, Apple Pay, Amazon Pay and Google Pay. Bank transfer will only be accepted in exceptional cases with LISTA SÉPTIMA's prior express agreement.

9.4. Nature of the service and refund policy

Payment corresponds to a provision of document management and technical services, irrespective of the success or volume of subsequent rentals.

Refund conditions:

Processing started: Once LISTA SÉPTIMA has initiated any process with the authorities, the amount is non-refundable under any circumstances.
Before processing: If the Owner has made payment but LISTA SÉPTIMA has not yet initiated any management or administrative contact, the Owner may request and receive a full refund of the pack.

9.5. Extraordinary services and bespoke management

For any administrative or technical management NOT expressly included in the packs described above, LISTA SÉPTIMA and the Owner may agree the provision of additional services through a specific quote.

9.6. Liability and important exclusions

Document accuracy: The accuracy, correctness and validity of the technical and personal information provided is the Owner's sole responsibility.
Profile activation: The vessel will not be visible or bookable until payment has been verified and documentation has been duly validated by the maritime authority.
Collaborative partners: The Owner expressly consents to management being carried out by LISTA SÉPTIMA's collaborative advisory partners.
Advisory exclusion (Basic Pack): The Basic Pack does NOT include tax, financial advisory or personal consultancy services beyond the nautical documentation strictly required for rental.

10. Service and Website availability

LISTA SÉPTIMA undertakes to make every effort to ensure that the Service and the Website are available 24 hours a day, 7 days a week without interruption, except where changes or updates are required.

LISTA SÉPTIMA does not guarantee permanent availability of the Website and the Service. The User may not hold LISTA SÉPTIMA liable for any faults, irregularities, errors or interruptions.

11. Liability

11.1. Limitation of liability

LISTA SÉPTIMA acts as a formal intermediary in contracts. However, LISTA SÉPTIMA assumes no liability for:

The maintenance, upkeep or condition of the Vessel.
Direct communication between Owner and Renter.
The handover or collection of keys.
Delays in the delivery or return of the Vessel.
Any agreement or condition privately arranged between the Owner and the Renter outside what is established on the platform.

LISTA SÉPTIMA's liability shall not, except in cases of gross negligence or wilful misconduct, exceed the total amount invoiced by LISTA SÉPTIMA to the User for the Rental or Experience giving rise to the liability event.

LISTA SÉPTIMA shall not in any event be liable for indirect damages.

11.2. Liability exclusions

LISTA SÉPTIMA is not liable in the following cases:

Improper or unlawful use of the Website and/or Service by the User.
Unavailability of the Website and/or Service in accordance with article 9.
Fraudulent intrusion by a third party into the Website and/or Service.
Non-conformity of the Vessel's condition with the Listing.

11.3. Hypertext links

The Website may include links to other websites or internet sources over which LISTA SÉPTIMA has no control. LISTA SÉPTIMA is not liable for any damages or losses resulting from accessing or using such external content.

12. Force majeure

The parties agree that the following constitute force majeure events:

Special weather forecasts preventing sea voyages.
Legislative and regulatory changes.
Natural disasters, fires, storms, floods, wars and terrorist attacks, strikes, illness, electrical surges, breakdowns in refrigeration systems and computer equipment, blockages and slowdowns of electronic communication networks and, more generally, any unforeseeable event beyond the control of LISTA SÉPTIMA and the Users.

13. Confidentiality

LISTA SÉPTIMA undertakes to keep confidential all information collected when creating a User account.

Personal data of Owners and Users may only be shared with LISTA SÉPTIMA's collaborators for the correct provision of the services requested, and always with the User's express authorisation, in cases such as:

Taking out insurance related to the Vessel.
Managing administrative formalities required for the operation or registration of the Vessel.
Carrying out technical inspections or other mandatory checks on the Vessel.

14. Suspension / Termination

The User acknowledges that LISTA SÉPTIMA has the right to suspend access to the Service or to terminate its contractual relationship with the User, or to delete any User account, with simple notification by email and without further formality, in particular:

In the event of improper or unlawful use of the Service.
In the event of a breach of the GTC.
In the event of more than two booking cancellations without force majeure cause.
In the event of particularly negative reviews from other Users.
In the event that LISTA SÉPTIMA ceases to operate the Website and/or Service.

The User may terminate their User account at any time by emailing [email protected].

15. Personal data

16. Intellectual property and copyright

16.1. LISTA SÉPTIMA's intellectual property and copyright

"LISTA SÉPTIMA" and the logo appearing on the Website are registered trademarks owned entirely by LISTA SÉPTIMA. No licence is granted to the User.

LISTA SÉPTIMA holds the intellectual property rights associated with the Service and the Website, including software elements, ergonomics, layout, graphic elements, logo and design.

16.2. Users' and third parties' intellectual property and copyright

The User undertakes to respect the copyright of other Users and of third parties. LISTA SÉPTIMA reserves the right to deactivate or cancel the account of users who infringe the copyright or other intellectual property rights of third parties.

17. Severability

If one or more provisions of the GTC are declared null and void under applicable law or by a final decision of a competent jurisdiction, the remaining provisions shall retain their full force and effect. A party's failure to invoke a breach by the other party of any provision of the GTC shall not be interpreted as a waiver of the right to invoke such breach in the future.

20. Applicable law

These GTC are governed exclusively by Spanish law.

LISTA SÉPTIMA will not consider any claim if there is no contract signed by the Renter and the Owner.

Claims must be sent to LISTA SÉPTIMA within 24 hours of taking possession of the Vessel at [email protected].

LISTA SÉPTIMA is not a party to the contract binding the Renter with the Owner; its role is limited to assisting both parties in reaching an amicable agreement.
